Terms of Service

1. Who We Are And Acceptance
Joyfully Invited is operated by OpStudio ("we", "us", "our").

By creating an account, purchasing an event, or using the service, you agree to these terms. If you do not agree, do not use the service.
2. The Service
Joyfully Invited provides hosted event pages, QR-based guest camera access, bingo, guest notes, host curation tools, and public album sharing. The service is intended for private or invited events and is not a replacement for professional photography.
3. Eligibility And Accounts
You must be an adult and legally able to enter into these terms to create an account or purchase an event. You are responsible for keeping your account credentials secure and for activity that happens under your account. Account authentication is provided through Clerk.
4. Host Responsibilities
Hosts are responsible for:
- choosing whether Joyfully Invited is appropriate for their event;
- communicating the QR link to guests;
- obtaining any consent required at their venue or event, and making sure guest use of the camera is allowed under the rules of the event and the venue;
- reviewing photos and notes before public sharing.
These are contractual responsibilities. They are part of using the service appropriately and are described further in our Privacy Policy.
5. Guest Content And Acceptable Use
Guests may upload photos and leave notes. Hosts can hide photos, curate albums, choose which notes appear in a public album, and use approve-first moderation where enabled.
You and your guests must not upload or share content that is unlawful, abusive, harassing, hateful, or non-consensual, that infringes someone else's rights, or that otherwise breaks the law. We may remove content or suspend access where we reasonably believe these terms have been broken.
6. Payments, VAT, And Invoicing
The launch product is a one-time event purchase, with optional add-ons, processed through Stripe. Prices are shown at checkout. Where VAT or other taxes apply, they are calculated at checkout and shown on your invoice. OpStudio BV is the seller and issues your invoice. The exact VAT treatment and the payment statement descriptor for each market are being finalised as part of our launch preparation.

Right Of Withdrawal (EU Consumers)
EU consumers generally have a 14-day right to withdraw from a distance contract. Because an event is a dated, time-bound service, by purchasing and starting to use the event (for example by opening guest access or generating guest activity) you request that we begin performance immediately and you acknowledge that your right of withdrawal is lost once the service has been fully performed.
Counsel note: Confirm the withdrawal-right wording, the point at which performance is treated as begun or complete, and how it interacts with the cancellation and refund terms below.
7. Cancellation And Refund Review
Hosts may request self-service cancellation from the control room before the event starts and before any guest photos, guest notes, or bingo progress have been created. A successful cancellation closes guest access and creates a manual refund review for the base event purchase.
Refunds are reviewed through support and the Stripe Dashboard. A cancellation request does not mean a refund has already been paid. Once guest activity has started, the event has been consumed and refunds are not issued through self-service tools. Manual support exceptions may be handled case by case.
8. Intellectual Property And Content Licence
You and your guests keep ownership of the photos and notes created at your event. To operate the service, you grant us a limited licence to host, process, generate thumbnails from, display, and share that content as needed to provide the features you have chosen (for example public album links and album emails). We do not use event photos or notes to train models or for advertising. The Joyfully Invited name, branding, and software remain our property.
9. Availability And Disclaimers
We aim to keep the service available during active events, but no online service can guarantee uninterrupted availability. Hosts should perform a QR and camera smoke test before their event starts. The service is provided "as is" to the extent permitted by law, without warranties beyond those that cannot be excluded under applicable law, including mandatory consumer protections.
10. Liability
To the maximum extent permitted by law, we are not liable for indirect or consequential loss, including lost profits, lost data or photos, or reputational harm. Our total liability for any claim arising from or relating to the service is limited to the greater of the amount you paid us for the event giving rise to the claim, or fifty euro (€50). Nothing in these terms limits liability that cannot be limited under Belgian or EU law, including liability for death or personal injury caused by negligence, for fraud, or for your mandatory consumer rights.

11. Indemnity
You agree to cover the reasonable costs and damages we incur from a third-party claim that results from your misuse of the service or your breach of these terms, including content you or your guests upload that you had no right to share or that infringes someone else's rights. This does not apply to the extent a claim arises from our own negligence or breach, and it does not affect your mandatory consumer rights.

12. Suspension And Termination
You can stop using the service at any time. We may suspend or end access to an event or account if these terms are seriously or repeatedly breached, if we are required to by law, or where necessary to protect guests or the service, and we will give notice where it is reasonable to do so. Event cancellations and refunds are handled as described in section 7. When an event ends or access is terminated, event data is retained and deleted in line with our Privacy Policy.

13. Governing Law
These terms are governed by the laws of Belgium, without prejudice to any mandatory consumer protection rights you have in your country of residence. The courts competent for OpStudio BV's registered seat in Belgium have jurisdiction over disputes, except where mandatory consumer-protection rules allow a consumer to bring or face proceedings in their own country of residence.

14. Changes And Contact
We may update these terms as the product and our legal review evolve. Material changes will be reflected by the "Last updated" date above. Continued use after an update means you accept the revised terms.
